  • To the fullest extent permitted by law, Glide3 shall not be liable for any losses or damages arising out of or in connection with your use of Glide3's website (except as stated in relation to Glide3's Terms of Sale in relation to sale of Glide3 vouchers) including, without limitation, any loss of profit, loss of revenue, economic loss, indirect or consequential loss incurred by you, howsoever caused, including by negligence or breach of duty (whether statutory or otherwise) and whether or not such losses or damages were reasonably foreseeable at the time you entered into this agreement.

ASSIGNMENT

RIGHTS OF THIRD PARTY

  • This agreement shall not confer and shall not purport to confer on any third party any benefit or any right to enforce any term of this agreement for the purposes of the Contracts (Rights of Third Parties) Act 1999.

APPLICABLE LAW AND DISPUTE RESOLUTION

  • This agreement shall be governed and construed in accordance with the laws of England and Wales, irrespective of the jurisdiction where you are based. In the event of any dispute which arises out of or in connection with this agreement, each party irrevocably submits to the exclusive jurisdiction of the English courts for resolution of such dispute. The place of performance of this agreement shall be England.

ENTIRE AGREEMENT

  • This agreement and any documents incorporated by reference herein constitute the entire agreement and understanding between Glide3 and you regarding the access and the use of Glide3's website and supersede all prior agreements and understandings. Nothing in this clause shall, however, operate to limit or exclude any liability for fraud.

Terms and Conditions of Sale

INTRODUCTION

  • These terms and conditions apply to vouchers (the expression "vouchers" shall also include gift packs where relevant) sold by Glide3 Limited ("Glide3" or "us" or "we" or "our" via Glide3's website ("www.Glide3.com").
  • By placing your order, you (the purchaser) are deemed to have accepted these terms and conditions. Glide3 reserves the right to make any changes at any time to these terms and conditions by changing them on Glide3's website.
  • You should print a copy of these terms and conditions for your records.

REGISTRATION

  • You will be required to register your personal details in order to make an order. Your personal details will be held in accordance with our Privacy Policy. You can read our Privacy Policy by clicking this link Privacy Policy.

PRICE AND AVAILABILITY

  • All prices (are inclusive of delivery charges and VAT) of the vouchers are as shown on our website. All prices are in Pound Sterling.
  • Prices, special offers and availability information are subject to change without notice. However you will be advised of any changes to price, special offers and availability when you select an item for purchase and place it in your shopping basket i.e. before you make an order. Any terms of any special offers shall also form part of these terms and conditions.

PAYMENT

  • You can make payment using two methods: cheque or bank transfer. Payment can be made by sending us a cheque as explained in the "ORDERS" clause below. Alternatively you can choose to make payment via bank transfer, to the following account: Sort code: 12-24-81 Account number : 06830360. The voucher will be sent to you after the cheque or bank transfer has cleared.

ORDERS

  • Online
    When you place an order online, you will have the opportunity to check the details of your order and correct any errors before placing the order. When you place your order you are making an offer to buy. You will be sent an e-mail ("ACKNOWLEDGEMENT OF ORDER") confirming receipt of your order. The ACKNOWLEDGEMENT OF ORDER is not acceptance of your offer. Once payment has cleared and your offer has been accepted you will be contacted by us via e-mail confirming the details of your order ("ORDER CONFIRMATION"). At this time a legally binding contract will be formed and your voucher will be sent to you in accordance with these terms and conditions.
  • Offline
    If you would like to place an order offline, send a letter to Glide3 Limited, 17 Ensign House, Admirals Way, Canary Wharf, London E14 9XQ with the details of your order which should include details of the items ordered, price, your name, your address and delivery address, e-mail address and telephone number together with a cheque. The cheque should be made payable to:Glide3 Limited. When you send this letter you are making an offer to buy. You will be sent an e-mail or letter ("ACKNOWLEDGEMENT OF ORDER") confirming receipt of your order. The ACKNOWLEDGEMENT OF ORDER is not acceptance of your offer. If your offer has been accepted you will be contacted by us via e-mail or letter confirming that your offer has been accepted ("ORDER CONFIRMATION"). At this time a legally binding contract will be formed and your voucher will be sent to you in accordance with these terms and conditions.

DELIVERY

  • Vouchers are delivered by 1st Class post. Your voucher will be sent in plain packaging. Every effort will be made to deliver the vouchers as soon as possible after your payment has cleared. However Glide3 will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in a delivery. If the voucher is not received and you believe it may have been lost in the post, please inform as soon as possible. We can then send you a replacement duplicate voucher. Please note that this duplicate voucher will expire on the same date as the original lost voucher.

PUBLIC HOLIDAYS

  • Delivery arrangements including delivery changes, order dates, booking arrangements are subject to change during certain periods of the year such as the Christmas Period as well as other Public holidays. Please check our website for such changes or call us on 0845 226 0748 .

DESCRIPTIONS AND PHOTOGRAPHY

  • Glide3 endeavours to provide information which is accurate at the time of publication on our website and in promotional literature. However information is subject to change. The activities may change slightly from time to time. You can contact us on 0845 226 0748 for details of the activities.
  • Any images relating to activities on Glide3's website are not intended to be an accurate representation of any specific activity. They are intended to give a general idea of the activity described and do not form part of any contract between you and Glide3 Ltd.

BOOKING ACTIVITIES

  • In order to use your voucher for your activity, you must first book your activity. You will be given a booking confirmation reference when you make your booking.
  • You should not attend the activity venue until you have obtained your booking confirmation reference. We have no liability if you fail to follow the booking procedure in the information sent with the voucher.
  • All activities are subject to availability. Details of availability are available by calling us on 0845 226 0748 . If you have a specific date upon which you would like use your voucher, you should contact us as soon as possible to make your booking. Bookings are not confirmed until you receive your booking confirmation reference from us. We may ask you to return the original voucher to us for certain activities before we can confirm your booking. You should not make any arrangements in connection with the activities until you have received your booking confirmation reference.
  • If you change a booked date, you have to pay an administration charge of 10% of the price of the voucher(s) up to a maximum amount of £100 to re-book the activity. We will have already incurred costs when we made your booking. Re-booking means we will incur further costs. The level of charges which are applicable is dependent on when you inform us that you want to change a booked date. If you give us late notification, you will incur higher charges subject to the maximum amount of £100. We recommend that you contact us as soon as possible if you would like to change a booked date.

ACTIVITIES

  • Changes
    Glide3 reserve the right to discontinue an activity, venue, or individual supplier at our own discretion. In the event this happens in relation to a booked activity, we will notify you and provide you with a suitable alternative and exchange your voucher for the alternative activity of the same value.
  • Glide3 also reserve the right to make minor changes to your activity. An example of a minor change is a change to the schedule for the order of the activities.
  • Locations
    We use a variety of locations and venues for our activities. We do not own these locations or venues. We may need to change these locations and venues for reasons beyond our control, for example change of ownership. In the event this occurs in relation to a location or venue where your activity was booked, we will notify you and we will provide you with a suitable alternative.
  • Duration
    Description of the duration of activities are approximate times. They are provided to give guidance as to the expected duration of the activities. Schedules regarding the order of activities are for guidance purposes and are subject to change.
  • Spectators
    Spectators are usually permitted to attend activities. If you would like to bring spectators, you should inform us when you book the activity. You will be informed whether spectators are permitted. Spectators are required to conduct themselves properly and comply with any rules and regulations at the activity venue. Spectators who are considered to be under the influence of drugs or alcohol will not be permitted onto the activity venue.
  • Restrictions
    Restrictions may apply to activities for safety reasons such as restrictions relating to age, size or health. Details of any applicable restrictions can be found our website. You should read this information carefully before you purchase any vouchers. You must satisfy yourself that the activity is suitable for the intended recipient of the voucher. We are not responsible for vouchers which are purchased where the activities are not suitable for the intended recipient. VOUCHERS

  • We suggest you look after your voucher carefully. We have no responsibility for any loss or misuse after the voucher has been delivered. No refunds shall be made except as stated in these terms and conditions. A voucher is valid for a period of 9 months unless otherwise stated on the voucher. Activities must be booked by the expiry date of the voucher but they do not have to be taken by that date. The following details will be printed on each voucher:
    • reference number
    • issue number
    • date of purchase
    • expiry date

SUPPLIERS

  • We provide most of the activities described on our website. However some activities featured on this website are provided with the assistance of suppliers (for example, caterers and providers of venues) who are independent contractors which means that they are not employees or agents of Glide3. We select suppliers who we consider to be experienced, however we are not responsible for their equipment, facilities, services or employees. We have no liability for any loss or damages arising out of or in connection with any supplier's equipment, facilities, services or employees except to the extent that we have directly caused such loss or damage due to breach of this contract by us or our negligence. You and any spectators that you invite are required to comply with the suppliers' rules and regulations.

LIABILITY

  • In the event of a breach of this contract by Glide3 or negligence of Glide3, Glide3 shall not be liable for any loss, damage, cost or expense arising out of the breach or such negligence which was not reasonably foreseeable at the date of this agreement, except in respect of death or personal injury caused the negligence of Glide3. Subject to the previous sentence Glide3's total liability arising out of or in connection (including by negligence) with these terms and conditions or voucher(s) shall not exceed the price of the voucher(s) or product(s) supplied.

CANCELLATIONS AND REFUNDS

  • You have the right to cancel your purchase and return any vouchers within 14 days of purchase and a full refund will be paid as long as a booking has not been made.
  • All refunds will incur an administration charge (unless otherwise stated in these terms and conditions). The administration charge shall be 10% of the price of the voucher(s) up to a maximum amount of £100. The level of charges which are applicable is dependent on when you inform us that you want a refund. For example, if you have booked a date for your activity and give us late notification of your cancellation, you will incur higher charges subject to the maximum amount of £100.
  • To make a cancellation and request a refund you must return your voucher at your own cost to Customer Services, Glide3 Ltd, 17 Ensign House, Admirals Way, Canary Wharf, London E14 9XQ along with a covering letter detailing the reason for your refund request. We have no responsibility for any loss after the vouchers have been delivered to you or the addressee. We strongly recommend that you return the voucher by recorded delivery or obtain a certificate of posting.
  • Once you have notified Glide 3 that you are cancelling the contract, we will refund or recredit the person who purchased the voucher(s) within 30 days for any sum that has been paid for the voucher(s).
  • We may have to cancel an activity in the event that Glide3 or our suppliers are affected by an event outside of our control or our suppliers' control. Examples of such events include weather and mechanical breakdown. We will notify you as soon as possible if we have to cancel an activity. We will offer you an alternative date or time for the activity to take place. We have no liability for any expenses or costs you incur due to such cancellation. As our activities are outdoor leisure activities if they cannot be rescheduled, no refund shall be made.

LATE BOOKING DEALS

  • We sometimes have special offers with late availability activities which have to booked within a short space of time. Vouchers cannot be sent by post as they would not arrive in time. In such circumstances, details will be provided over the telephone. Bookings will also be made by telephone and cannot be changed after they have been made. These special offer purchases cannot be cancelled and refunded.

SAFETY AND INSURANCE

  • All activities are covered by Glide3 Public Liability Insurance up to a value of £2 million.
  • These activities may involve some personal risk. You may be asked to sign an acknowledgement or declaration on the day of the activity. You should read this document carefully before signature. Such document may contain various acknowledgements or declarations regarding your compliance with any safety restrictions (e.g. health, age, size), confirmation of your agreement to comply with safety procedures notified to you, declarations regarding your health and other similar matters.
  • Personal Accident Insurance is included in the price of each experience.
  • Participants in activities must conduct themselves properly at the activity venue. Participants will not be permitted to participate in any activity if they are under the influence of drugs and/or alcohol. Participants should comply with any safety procedures notified to them, as well as any rules regarding general conduct.
  • Nothing in these terms and conditions shall exclude Glide3's liability for personal injury or death caused by any act or omission of Glide3.

TRADEMARKS

  • Glide3 name and logo are trade marks of Glide3 Ltd. No-one may use our trademarks without our express written permission. Neither the purchaser nor the recipient of voucher is entitled to use any Glide3 trade marks or logos.

MISCELLANEOUS

  • This agreement contains all the terms relating to all vouchers, whether or not the person who uses the voucher purchased it. Nothing in this agreement excludes liability for fraud. Nothing in these terms and conditions shall affect your statutory rights as a consumer. As a consumer you have certain rights such as protection from unfair terms. Further details about your statutory rights can be found on the DTI website (www.dti.gov.uk).
  • We assume that you are a UK resident unless otherwise notified.
  • You cannot assign any of your rights under these terms and conditions.
  • Any dispute or claim relating to these terms and conditions or vouchers shall be dealt with by the English Courts. These terms and conditions are governed by and shall be interpreted in accordance with the laws of England. The place of performance of this agreement shall be England.
  • This agreement will not be filed. This agreement and all sales will be concluded in English.
